Terms and Conditions for Prayas AI

1. Service Description

Prayas AI provides an artificial intelligence-powered platform designed to assist Union Public Service Commission (UPSC) aspirants. The Service includes, but is not limited to:

• AI-based evaluation of uploaded handwritten or typed answer sheets for UPSC Mains examinations.
• Detailed feedback, scoring, and analysis based on proprietary AI models.
• Daily Practice Questions (DPQs).
• Performance analytics and progress tracking.

You acknowledge that the feedback and scores provided by the AI are for practice, guidance, and educational purposes only. They are not a guarantee of performance in the actual UPSC examination and should be used as a supplementary tool for your preparation.

2. User Accounts

Eligibility

You must be at least 18 years old to create an account and use the Service.

Account Creation

You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your account credentials (including your phone number and any One-Time Passwords).

Account Responsibility

You are solely responsible for all activities that occur under your account, whether or not you have authorized such activities. You must notify us immediately of any unauthorized use of your account.

3. User-Generated Content

Your Content

You retain all ownership rights to the answer sheets, text, and other content you upload to the Service ("User Content").

License to Us

By uploading User Content, you grant Prayas AI a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, process, adapt, modify, and display your User Content for the purpose of operating, providing, and improving the Service. This license explicitly includes:

1. Using your anonymized User Content to train and enhance our AI models. We will make commercially reasonable efforts to de-identify your User Content for this purpose.
2. For any User Content that receives a high score or is otherwise deemed exemplary by our system, you grant us the right to publish, display, and distribute such User Content (in whole or in part) to other users of the Service and the public as a "Model Answer," "Topper Answer," or for other educational purposes. We will make commercially reasonable efforts to display such content in an anonymized format.

Your Responsibility

You represent and warrant that you have all the rights, power, and authority necessary to grant the rights granted herein to any User Content that you submit. You agree that you will not submit any User Content that is copyrighted, protected by trade secret, or otherwise subject to third-party proprietary rights, unless you are the owner of such rights or have permission from their rightful owner.

4. Acceptable Use

You agree not to use the Service to:

• Upload or transmit any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
• Violate any applicable national or international law, including the Information Technology Act, 2000.
• Infringe on the intellectual property rights of Prayas AI or any third party.
• Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the Service.
• Use any robot, spider, or other automated means to access the Service for any purpose without our express written permission.
• Interfere with or disrupt the integrity or performance of the Service or the data contained therein.

5. Intellectual Property Rights

Excluding your User Content, all content on the Service, including the website design, text, graphics, logos, icons, the AI models, evaluation parameters, and the selection and arrangement thereof (collectively, "Prayas AI Content"), is the exclusive property of Prayas AI and is protected by Indian and international copyright, trademark, and other intellectual property laws.

6. Payments, Credits, and Refunds

Evaluation Credits

Certain features of the Service may require the purchase of evaluation credits ("Credits"). All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

Payments

You agree to pay all fees associated with your purchase of Credits. We use a third-party payment processor to handle all payment transactions.

Refund Policy

All purchases of Credits are final and non-refundable, except as required by law. Unused Credits are not redeemable for cash. We reserve the right to modify our prices and billing methods at any time.

7. Disclaimers and Limitation of Liability

"AS IS" Service

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Prayas AI makes no warranties, express or implied, regarding the accuracy, reliability, or completeness of the AI-generated evaluations. We do not warrant that the Service will be uninterrupted, error-free, or secure.

No Guarantee of Success

The evaluations are generated by an AI and are intended as a study aid. They may contain errors or omissions. Prayas AI does not guarantee any specific outcome or score in any official examination.

Limitation of Liability

To the fullest extent permitted by law, in no event shall Prayas AI, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory.

8. Indemnification

You agree to defend, indemnify, and hold harmless Prayas AI and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; or b) a breach of these Terms.

9. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Gurugram, Haryana, India.

10. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
